Terms of Service

These Terms of Service (“Terms”) govern your use of the Quitwell mobile application (“Quitwell,” the “app”), published by Trekka (“we,” “us,” or “our”). By downloading, accessing, or using Quitwell, you agree to these Terms. If you do not agree, please do not use the app.
1. Who can use Quitwell
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Quitwell. By using the app, you confirm that you meet this requirement and that the information you provide is accurate.
2. Your device and data
Quitwell does not require an account to use its core features. The cravings, triggers, and history you log are stored locally on your device, and you are responsible for that data — including backing up your device and understanding that deleting the app permanently removes your Quitwell data. How we handle information is described in our Privacy Policy.
3. Subscriptions and billing
Emergency SOS support is free, always. Quitwell also offers optional paid subscriptions (“Quitwell Premium”) that unlock Milestones, Patterns, and personalized ranking. Subscription options are:
- Monthly — $3.99 USD per month.
- Quarterly — $9.99 USD per 3 months.
- Annual — $34.99 USD per year, with a 7-day free trial for new subscribers. If you do not cancel before the trial ends, your subscription will begin and you will be charged.
Billing is handled by Apple through your App Store account using StoreKit. By subscribing, you authorize Apple to charge your Apple ID payment method. Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your device Settings under your Apple ID → Subscriptions. Prices may vary by region and are subject to change; any change will apply only to future billing periods.
Refunds for App Store purchases are handled by Apple in accordance with Apple's policies. We generally cannot issue refunds directly.
4. Acceptable use
You agree not to:
- Use Quitwell for any unlawful purpose or in violation of these Terms.
- Attempt to reverse-engineer, decompile, scrape, or interfere with the app or its underlying services.
- Abuse, overload, or attempt to gain unauthorized access to our systems or those of our providers.
- Upload content you do not have the right to, or that is unlawful, harmful, or infringing.
- Resell, redistribute, or commercially exploit the app or its content.
5. Intellectual property
Quitwell, including its design, branding, and software, is owned by Trekka and protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the app for its intended purpose. The data you log remains yours.
6. Disclaimer of Warranties & Limitation of Liability
Please read this section carefully. It limits our liability and explains important things about how Quitwell works.
Not a medical device
Quitwell is a wellness tool, not a medical device. It doesn't replace professional care. If you're using nicotine replacement therapy or have a medical condition, talk to a doctor. Quitwell does not diagnose, treat, or cure nicotine dependence or any medical condition, and it does not guarantee any particular outcome, including successfully quitting vaping.
No professional advice
Quitwell is not a substitute for professional medical, psychological, or addiction-treatment advice. If you are experiencing a medical emergency or crisis, contact emergency services or a licensed professional. Do not rely on Quitwell for decisions that affect your health.
“As is” / “as available”
The app and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your expectations.
Limitation of liability
To the maximum extent permitted by law, Quitwell / Trekka and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from or related to your use of (or inability to use) the app — even if advised of the possibility of such damages.
Liability cap
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the app is limited to the amount you paid for your subscription in the twelve (12) months preceding the claim — or $0 if you are a free-tier user.
Indemnification
You agree to indemnify, defend, and hold harmless Quitwell / Trekka and its developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the app or your violation of these Terms.
7. Changes to the app and these Terms
We may update, change, or discontinue features of the app at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of Quitwell after changes take effect means you accept the revised Terms.
8. Termination
We may discontinue or limit access to Quitwell if you violate these Terms or use the app in a way that could cause harm or legal liability. You may stop using the app at any time by deleting it from your device, which also removes your local Quitwell data.
9. Governing law
These Terms are governed by the laws of New York, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the app will be subject to the courts located in New York, unless otherwise required by applicable law.
